The purpose of this article was focused on analyzing the adjacent factors related to human rights in women victims of sexual violence in the context of the armed conflict. The quantitative method of descriptive approach was selected under the systematic review technique using the PRISMA guide. As a result, it was obtained that women continue to be instrumentalized in wars, their physical and psychosocial vulnerability persisting in all spheres of life; This being a phenomenon that continues to growglobally given the (...) characteristics associated with political, social and religious structures. As a conclusion, it was identified that, although there are jurisprudential guidelines and policies, these are insufficient and do not protect the human rights of women victims. (shrink)

Affirmative action is standardly pursued in relation to admissions to prestigious universities, in hiring for prestigious jobs, and when it comes to being elected to parliament. Central to these forms of affirmative action is that they have to do with competitive goods. A good is competitive when, if we improve A’s chances of getting the good, we reduce B’s chances of obtaining the good. I call this Competitive Affirmative Action. I distinguish this from Non-competitive Affirmative Action. The latter has to (...) do with non-competitive goods, e.g., being granted early parole or freedom from arbitrary arrest. I argue that some of the most prominent objections against affirmative action—in particular, the reverse discrimination objection and the merit objection—speak less against Non-competitive Affirmative Action. And that some of the most prominent arguments in favor of affirmative action, insofar as they justify Competitive Affirmative Action, also justify Non-competitive Affirmative Action. (shrink)

The Neoplatonic commentaries on Aristotle’s works have always been considered somehow suspicious. That is partly related to the doctrinal commitments of the commentators, partly with the hermeneutical strategies to which they seem to recur. Both of these reasons have also give place to the accusation of distortion and misunderstanding of Aristotle’s philosophy. In the following paper I want to perform an exercise of disclosing the hermeneutical procedure that one of this commentators applies to one of the passages of the first (...) book of the De Anima. The commentator is Philoponus, the passage is the refutation of the soul-harmony theory. My aim is to show that, despite the doctrinal commitments that the commentator may have, his methodology follows Aristotelian guidelines. I hope that this could open perspectives on the value that the commentators must have as philosophers, rather than merely interpreters or paraphrasers. (shrink)

A recent quarrel over faultless disagreements assumes that disputes over evaluative sentences should be understood as regular, factual disagreements. Instead, I propose that evaluative disagreements should be understood in Lewisian terms. Language use works like a rule-governed game. In it, the assertion of an evaluative sentence is an attempt to establish one value as default in the conversation; its rejection, in turn, is in most cases the refusal to accept this move.

El kitsch no es solo una categoría que ha definido una de las posibles gramáticas estéticas de la modernidad, sino también una dimensión antropológica que ha tenido diferentes configuraciones en el curso de los procesos históricos. The essay offers a historical-critical look at the transformations that led from the early twentieth century kitsch to the contemporary neokitsch: from the genesis of kitsch to its affirmation as one of the most tangible manifestations of mass culture. Integrating with postmodern aesthetics, kitsch turns into neokitsch, an aesthetic that deliberately uses kitsch as its own syntax in the complex scenario of contemporary aesthetics. (shrink)

This paper examines a constellation of ethical and editorial issues that have arisen since philosophers started to conduct, submit and publish empirical research. These issues encompass concerns over responsible authorship, fair treatment of human subjects, ethicality of experimental procedures, availability of data, unselective reporting and publishability of research findings. This study aims to assess whether the philosophical community has as yet successfully addressed such issues. To do so, the instructions for authors, submission process and published research papers of 29 main (...) journals in philosophy have been considered and analyzed. In light of the evidence reported here, it is argued that the philosophical community has as yet failed to properly tackle such issues. The paper also delivers some recommendations for authors, reviewers and editors in the field. (shrink)

Consciousness is connected with the fact that a subject is aware and open to the manifestation of whatever appears. Existence, by contrast, is used to express the fact that something is given in experience, is present, or is real. Usually, the two notions are taken to be somehow related. This chapter suggests that existence is at best introduced as a metaphysical (or meta-experiential) concept that inevitably escapes the domain of conscious experience. In order to illustrate this claim, two case studies (...) are considered. The first case is provided by Descartes’s famous treatment of consciousness and existence in his Meditations on First Philosophy. The second case is meant to contrast the Cartesian approach by taking the opposite route, as delineated by Emanuele Severino (1929–2020) in his ‘fundamental ontology’. (shrink)

In this paper I will introduce a problem for at least those Humeans who believe that the future is open. More particularly, I will argue that the following aspect of scientific practice cannot be explained by openfuture- Humeanism: There is a distinction between states that we cannot bring about (which are represented in scientific models as nomologically impossible) and states that we merely happen not to bring about. Open-future-Humeanism has no convincing account of this distinction. Therefore it fails to explain (...) why we cannot bring about certain states of affairs, it cannot explain what I call the “recalcitrance of nature”. (shrink)

During the first quarter of the twentieth century, the French philosopher Henri Bergson became an international celebrity, profoundly influencing contemporary intellectual and artistic currents. While Bergsonism was fashionable, L. Susan Stebbing, Bertrand Russell, Moritz Schlick, and Rudolf Carnap launched different critical attacks against some of Bergson’s views. This book examines this series of critical responses to Bergsonism early in the history of analytic philosophy. Analytic criticisms of Bergsonism were influenced by William James, who saw Bergson as an ‘anti-intellectualist’ ally of (...) American Pragmatism, and Max Scheler, who saw him as a prophet of Lebensphilosophie. Some of the main analytic objections to Bergson are answered in the work of Karin Costelloe-Stephen. Analytic anti-Bergsonism accompanied the earlier refutations of idealism by Russell and Moore, and later influenced the Vienna Circle’s critique of metaphysics. It eventually contributed to the formation of the view that ‘analytic’ philosophy is divided from its ‘continental’ counterpart. (shrink)

He demonstrated that blood circulates into heart from veins and from the heart to arteries, paving the way to Harvey’s complete description of blood circulation. Moreover, he was the founder of botany as a systematic discipline, which he based, rather than on the observation of accidental similarities of plants, on the discovery of their vegetative-generative principle. I discuss Descartes’ metaphysics of selfhood, and relevant parts of contemporary philosophy regarding the first person. My two main concerns are the controversy that surrounds Descartes’ conception of conscientia, mistranslated as ‘consciousness’, and his conception of selfhood and its essential connection to conscientia. ‘I’-thoughts give rise to the most challenging philosophical questions. An answer to the questions concerning the peculiarities of the first person, self-identification and self-ascription, is to be found in Descartes’ notion of conscientia. His conception of selfhood insightfully (...) informs his conception of personhood. I offer a unified account of selfhood, conscientia, the first person, and personhood anchored in the self’s authority of reason and autonomy of freedom. (shrink)

This paper discusses a recent opposition between the influential dynamic semantic account of presupposition projection and a recent Gricean-pragmatic theory. The Gricean-pragmatic theory is partly motivated by an influential ob- jection to dynamic semantics based on the compatibility of dynamic systems with connectives and operators exhibiting deviant projection behaviors. By identifying key features of the role of prediction and explanation in semantics, it is argued that the objection is based on a mistaken conception of the involve- ment of empirical foundations (...) in semantic theories. The paper shows that the dynamic paradigm does not suffer from either predictive or explanatory inad- equacy. The chapter concludes that while it is too early to decide in favor of either approach, the Gricean alternative to dynamic semantics cannot be seen as motivated by a flaw in the latter theories. Many people are worried about the harmful effects of climate change but nevertheless enjoy some activities that contribute to the emission of greenhouse gas (driving, flying, eating meat, etc.), the main cause of climate change. How should such people make choices between engaging in and refraining from enjoyable greenhouse-gas-emitting activities? In this chapter we look at the answer provided by decision theory. Some scholars think that the right answer is given by interactive decision theory, or game theory; and moreover think (...) that since private climate decisions are instances of the prisoner’s dilemma, one rationally should engage in these activities provided that one enjoys them. Others think that the right answer is given by expected utility theory, the best-known version of individual decision theory under risk and uncertainty. In this chapter we review these different answers, with a special focus on the latter answer and the debate it has generated. (shrink)

This article argues that the reception of Augustinian ideas in Pascal and Nicole can be used to clarify what is distinctive in La Rochefoucauld’s treatment of self-relations. La Rochefoucauld does not share the Augustinian dichotomy between self-love at the price of forgetting God and love of God at the price of self-contempt that is prominent in both Pascal and Nicole. Rather, La Rochefoucauld develops a conception of an attitude towards the self that could be described as self-acceptance. As he describes (...) it, being open about one’s character faults falls short of self-esteem, if self-esteem is understood as involving a positive evaluation of one’s own character traits. However, it counterbalances these faults and can enhance the esteem in which we are held. And it offers a remedy for competing for social esteem which can be detrimental to our lives because the sincere person does not seek to be esteemed for qualities that are only pretended. At the same time, it overcomes an inflated self-image, thereby improving both social relations and the relation to the self. (shrink)

Las oraciones con predicados evaluativos son sensibles a la valoración realizada según un parámetro evaluativo contextual. Dos teorías han proporcionado explicaciones para este tipo de sensibilidad: el contextualismo y el relativismo de apreciación. En este trabajo presentaré una tercera opción que logra lo mismo que estas de una manera más sencilla. La teoría se centrará en dos pilares: una reconsideración del contenido expresado por las oraciones con predicados de gusto que parte de la articulación del parámetro evaluativo como una función (...) diádica, y los compromisos que la aserción de este tipo de oraciones impone sobre los hablantes y sobre el auditorio. Con ambas herramientas se logrará una teoría que podrá dar cuenta de acuerdos, desacuerdos y usos ecóicos de las oraciones evaluativas sin apelar a contextos de apreciación suplementarios a la teoría semántica estándar o a presupuestos de comunidad de los parámetros evaluativos. Sentences with evaluative predicates are sensitive to the valuation carried on under an evaluative parameter in the context. Two theories have provided an account for this kind of context-sensitivity: contextualism and assessment relativism. In this paper I will present a third alternative that achieves the same results in a simpler way. This theory is based on two main ideas: understanding the content expressed on the basis of an articulation of the evaluative parameter as a dyadic function, and the practical and linguistic commitments that the assertion of these sentences imposes over speakers and hearers. Both tools will result in a theory that can manage agreements, disagreements and echoic uses of evaluative sentences without the need to supplement the standard semantic theory with contexts of assessment or with presuppositions of commonality of the evaluative standard. Phenomenal concepts are the concepts that we deploy when – but arguably not only when – we introspectively examine, focus on, or take notice of the phenomenal character of our experiences. They refer to phenomenal properties (or qualities) and they do so in a subjective (first-personal) and direct (non-relational) manner. It is through the use of such concepts that the phenomenal character of our experiences is made salient to us. Discourse about the nature of phenomenal concepts plays an important role (...) in the philosophy of mind. For one, phenomenal concepts have been used to explain the epistemological relation that holds between a subject and her conscious mental states. Most prominently, however, discussions of phenomenal concepts figure in the on-going and multifaceted debate concerning the metaphysical status of consciousness. Even though some theorists have utilized phenomenal concepts in arguments purporting to show that consciousness is ontologically distinct from physical entities and processes, most accounts of phenomenal concepts are advanced having the opposite objective in mind: a proper articulation of the nature of phenomenal concepts, it is held, can defend the view that consciousness is physical against epistemic arguments to the contrary. The present entry focuses on the nature of phenomenal concepts as this is articulated and developed in attempts to defend the contention that conscious states are identical to (realized by, metaphysically necessitated by, or supervenient upon) physical states. I examine Michel Bitbol’s proposal of a metaphysical counterpart of neurophenomenology, arguing that such a metaphysics should address the issue of the origin of consciousness. This can be accomplished through panqualityism, which conceives of the subject and object of experience as grounded in a flow of pre-phenomenal qualities. I conclude by framing this view in terms of a critical metaphysics that is consistent with the pragmatic and existential dimension of neurophenomenology.

Laws are supposed to tell us how physical systems actually behave. The analysis of an important part of physical practice--abstraction--shows, however, that laws describe the behavior of physical systems under very special circumstances, namely when they are isolated. Nevertheless, laws are applied in cases of non-isolation as well. This practice requires an explanation. It is argued that one has to assume that physical systems have dispositions. I take these to be innocuous from an empiricist's standpoint because they can--at least in (...) principle--be measured. Laws can be applied whenever such a disposition is present, they describe how the physical system would behave if the disposition were manifest. (shrink)

Evaluative judgments imply positive or negative regard. But there are different ways in which something can be positive or negative. How do we tell them apart? According to Evaluative Sentimentalism, different evaluations (e.g., dangerousness vs. offensiveness) are grounded on different emotions (e.g., fear vs. anger). If this is the case, evaluation differentiation requires emotional awareness. Here, we test this hypothesis by looking at alexithymia, a deficit in emotional awareness consisting of problems identifying, describing, and thinking about emotions. The results of (...) Study 1 suggest that high alexithymia is not only related to problems distinguishing emotions, but also to problems distinguishing evaluations. Study 2 replicated this latter effect after controlling for individual differences in attentional impulsiveness and reflective reasoning, and found that reasoning makes an independent contribution to evaluation differentiation. These results suggest that emotional sensibilities play an irreducible role in evaluative judgment while affording a role for reasoning. (shrink)

Alongside the exponential development and application of machine learning algorithms, new ethical problems and solutions relating to their ubiquitous use in society have been proposed. This article builds on a review of the ethics of algorithms published in 2016, 2016). The goals are to contribute to the debate on the identification and analysis of the ethical implications of algorithms, to provide an updated analysis of epistemic and normative (...) concerns, and to offer actionable guidance for the governance of the design, development and deployment of algorithms. Around 1970, both Keith Donnellan and Saul Kripke produced powerful arguments against description theories of proper names. They also offered sketches of positive accounts of proper name reference, highlighting the crucial role played by historical facts that might be unknown to the speaker. Building on these sketches, in the following years Michael Devitt elaborated his well-known causal theory of proper names. As I have argued elsewhere, however, contrary to what is commonly assumed, Donnellan’s and Kripke’s sketches point in two rather (...) different directions, by appealing to historical or causal facts of different sorts. In this paper, I shall discuss and criticize Devitt’s causal theory, which confuses things, I shall argue, by mixing, so to speak, Donnellan’s and Kripke’s sketches. (shrink)

In this work my aim to show that it is possible to address emotions by paying special attention to the sources of conflict between cogni-tivists and non-cognitivists but by questioning the framework within which they have been erected. The path I propose aims to establish a new way of approaching the antagonism between somatic and cognitive approaches to emotions, which has had so much influence on the investigation of emo-tions, in light of one of the greatest problems that the somatic (...) approach faces: the problem of varia-bility. I will show how certain concepts acquire new meaning in the post-cognitivist framework and allow new (and better) answers to old problems regarding emotional phenomena. (shrink)

Open peer commentary on the article “Varela’s Radical Proposal: How to Embody and Open Up Cognitive Science” by Kristian Moltke Martiny. Upshot: I examine Varela’s relationship with Husserl’s phenomenology, highlighting Varela’s acknowledgment of the pragmatic dimension of its phenomenological reduction. I argue that Varela sees, in some developments of phenomenology, a deconstruction of the subject-object duality and an embodied view of the mind. I also highlight the existential dimension of Varela’s radical proposal, which contributes to further opening up and embodying (...) cognitive science. (shrink)

Discussions of the relation between confessionalization and early modern natural philosophy have tended to focus on the influence of certain theological doctrines characteristic of the different Christian denominations on specific analyses of the material world. By contrast, I would like to argue that an obstacle to formulating all-too general confessionalization claims derives from ecumenical uses of early modern natural philosophy that serve to provide rational grounds for commonly acceptable theological views. One such ecumenical approach can be found in the work (...) of Kenelm Digby. I develop such a line of interpretation by comparing Digby’s argumentative strategy with the argumentative strategies of one of his readers, Gottfried Wilhelm Leibniz, who in his early writings developed a sophisticated version of mechanical philosophy. Leibniz refers to Digby’s analysis of the powers of organisms, and, like Digby, he uses the limits of these powers as arguments for the existence of immaterial, and hence immortal human souls. The convergence between Digby and the early Leibniz on this central theological point can be seen as an outcome of the analysis of our common notions concerning the nature of matter and of the analysis of our common notions concerning the mental capacities of humans. Entscheidungen verweisen in einem begrifflichen Sinne auf Gründe. Entscheidungssysteme bieten eine probabilistische Verlässlichkeit als Rechtfertigung von Empfehlungen an. Doch nicht für alle Situationen mögen Verlässlichkeitsgründe auch angemessene Gründe sein. Damit eröffnet sich die Idee, die Güte von Gründen von ihrer Angemessenheit zu unterscheiden. Der Aufsatz betrachtet an einem Beispiel, einem KI-Lügendetektor, die Frage, ob eine (zumindest aktuell nicht gegebene) hohe Verlässlichkeit den Einsatz rechtfertigen kann. Gleicht er nicht einem Richter, der anhand einer Statistik Urteile fällen würde?

According to Descartes, physics rests on metaphysics. Various possible interpretations of this metaphor are considered. I will show that only a weak interpretation can be brought into accordance with other parts of Descartes' philosophy. According to the weak interpretation, physics has to presuppose metaphysics because the latter shows that contrary to widespread contemporary arguments the concepts of mathematical physics are adequate to describe nature. It is argued for this position by comparing the Regulae, where Descartes did not make use of (...) metaphysical arguments, with the Principia, where he did. (shrink)

The paper argues that it is essential for modes in Spinoza's metaphyics to both, to inhere in and to be caused by the substance.
